New West Virginia SOC code and county code requirements for quarterly reporting

If you have employees in West Virginia, ADP TotalSource® files quarterly reports with West Virgina that contain your employee information in our aggregate filing with the agency. While ADP TotalSource completes the filing, we need your help with new filing requirements, beginning with first quarter, 2024.

West Virginia issues final rule on child labor form for 14 and 15-year-olds

West Virginia has issued a final rule that amends child labor regulations. The final rule is effective immediately and set to expire on Aug. 1, 2027.

West Virginia enacts payroll card legislation

On March 23, 2022, Governor Jim Justice signed into law Senate Bill 245  (SB 245) eliminating the requirements that wage payment by payroll card and direct deposit be agreed upon in writing by both employer and employee.  The legislation becomes effective June 9, 2022.

West Virginia requires exemption process for COVID-19 vaccination requirements

Governor Jim Justice has signed legislation (House Bill 335) that requires employers to provide an exemption process as an alternative to COVID-19 vaccination mandates. House Bill 335 takes effect on Jan. 18, 2022.

West Virginia adopts new independent contractor test

West Virginia has enacted Senate Bill 272, also known as the West Virginia Employment Law Workers Classification Act (the Act). The Act takes effect on June 9, 2021.

West Virginia Employers No Longer Allowed to Prohibit Guns Inside Vehicles in Company Parking Lots

Pursuant to the Business Liability Protection Act, West Virginia employers may not prohibit any customer, employee, or other person lawfully on the premises from storing a lawfully possessed firearm inside of a privately-owned vehicle in a company parking lot, so long as the firearm is out of view and locked inside the vehicle.

The Medical Marijuana Train Arrives in West Virginia

On April 19, 2017, The West Virginia Medical Cannabis Act (“Act”) became law. In addition to permitting patients to use marijuana for medicinal use, the Act contains anti-discrimination and retaliation provision as well as other provisions that impact West Virginia employers.

Some definitions on "wage due" and Payment of Wages by Employers other than railroads has been changed. There has also been some information added regarding Cash orders; and employees separated from payroll before paydays.

Employers must pay voluntary and involuntarily terminated employees all wages due by the next regular payday and employees must be paid at least twice every month.
